Plainte: I am writing to inform you of some challenges we have encountered while clearing our date products, which were air-freighted to Nairobi, Kenya via Ugandan Airlines under the AfCFTA framework as part of the recent flag-off of the Nigeria - East/ Southern Africa Air Cargo route.

Although the goods have successfully arrived, we are currently experiencing delays at the point of clearing. The clearing agent has requested food safety documentation, which we have duly provided (HACCP and NAFDAC). However, we have come to understand that multiple government agencies are involved in the clearance process, each requiring various fees that together amount to over $600. This is over 75% of the invoice value of the goods.

These unexpected costs and procedural delays are impacting our timelines. We have engaged the agent to see what can be done about this situation since the goods are being shipped under the AfCFTA framework. We need your intervention to resolve this ASAP in order to prevent additional costs.

Plainte: Viva&Co Ghana Limited is a Ghanaian manufacturing enterprise which produces glass fibre-reinforced polymer (GFRP) bars. This product is made from the glass fibers and due to technological process afterwards receiving properties that are allowing it to be used as a construction material
As a Ghanaian manufacturer we were exited to start trading with other African countries using preferential treatment provided by AfCFTA.
However having an understanding that Tanzanian authorities might not consider our product as a one which falls under AfCFTA we have decided to test the waters and send first consignment to Tanzania by air. In December 2024, we have received Assessment document from TRA where import duty for our product was imposed at the level of 10%. At that time we were said, that our Certificate of Origin issued by the competent Ghanaian authority is not accepted by TZ customs. Since goods were already in TZ and we had no choice we had to pay full duties and clear the goods.
In order to get official clarification from the Tanzania Revenue Authority, on 15th January, 2025 we have submitted a letter to TRA requesting, inter alia, following:
1) Does HS code 7019.90 in the United Republic of Tanzania receives preferential treatment under Category A products (non-sensitive products) under AfCFTA?
2) Does rate of import duty for products with HS code 7019.90 in 2025 amounts to 5%?
3) Is a Certificate of Origin issued by a competent authority of the Republic of Ghana serves as enough evidence to a fact that goods originated from the Republic of Ghana?
In response, TRA by its letter dated 17th February, 2025 replied to us, that TRA failed to provide guidance/advance ruling on tariff classification and rate of the item listed because Viva failed to provide sufficient documents and justification to help officers to get better understanding of the good.
We are considering this answer as a part of the NTB for our product.
As an evidence to that we can say that, we have sent our product and cleared it under AfCFTA at the Republic of Kenya, where our product received preferential treatment and rate of import duty at the level of 5%. And as Kenya and Tanzania are part of East African Community, there shall be no differences between the classification of the goods.
Having clearance documents from the Kenya on hand on 9th March, 2025 we wrote another letter to the Commissioner for Customs & Excise of TRA and requested to provide another evaluation. However, so far we did not received a reply to this letter.
We consider all mentioned above as a pure NTB from the customs of the Republic of Tanzania.
 
Note d'état de la résolution: Two meetings were held (15 April 2025 and 26 June 2025) with relevant Authorities from both Ghana and Tanzania to resolve the matter. In addition, the Ministry of Industry and Trade of the United Republic of Tanzania also facilitated a consultative meeting with the Tanzania Revenue Authority on the 17 June 2025, in Dar Es Salaam. Clarity was provided on the requirements for verification of origin criterion in order to confirm the classification of the product. This information had however not been clearly communicated to the exporter (Viva and Co. Ghana Limited). On the 26 June during the second meeting the Ghana Revenue Authority agreed to verify the origin criteria of the product (glass fibre-reinforced polymer (GFRP) bars) and ensure that the certificate of origin issued by the Authority is duly endorsed before the next consignment is sent to Tanzania. ViVa and Co. Ghana Limited to communicate with the Ghana Revenue Authority to ensure that all necessary documentation is provided for the next consignment. The meeting also encouraged effective communication between the Ghana Revenue Authority and the Tanzania Revenue Authority to resolve any outstanding issues regarding the certificate of origin for future consignments.

Plainte: We are facing challenges in receiving down payments from importers of Sisal fibre in Ghana. We are required to submit a Bill of exchange to facilitate the release of part payments by the National Investment Bank of Ghana. This has made it difficult for us to receive payments in time. Before this requirement, we would receive our payments in 3 days (part payment, 70% of the full payment) and the balance in 21 days. With the new requirement, it will take us 21 days to receive the part payment and 63 days to receive the full payment. There are also additional courier costs to courier documents from Tanzania to Ghana increasing the cost of doing business. The new requirement started on 1st of May 2024 and before that we used to trade with Ghana without the need to submit the Bill of Exchange. The requirement applies for payments above US$50000. Were possible, the Bill of exchange requirement must waived to allow ease of doing business and to revert back to the status quo before May 2024.

After the extension of threshold of allowing advance payment from $50,000.00 to $200,000.00 by the Bank of Ghana effective from the 1st of July 2024, Mr Nicholas Noa (from NANONA AGROCARE LIMITED) indicated that business with his Ghananian customers is running smoothly.

Plainte: La société ABSH exporte la gomme arabique. En ce jour du 06 fevrier elle acheminait plusieurs convois de gomme arabique vers les Etats Unis. Les autorités douanières au poste de TOUBORO ont demandé des papiers attestant la fumigation de la gomme arabique. Cette demande de fumigation de la gomme arabique en direction des Etats unis n'est pas acceptable car aux Etats la gomme qui a subi la fumigation est interdite d'entrée. L'incident a fait perdre duré plus d'une journée à la socitéé..

Plainte: La Société COTONTCHAD exporte du coton graine. Depuis deux ans elle fait face ce même problème enregistré en janvier. Les conteneurs en partance pour les Etats Unis sont bloqués plusieurs jours pour des raisons de disponibilités des conteneurs et de traitement de la demande de service de fret. En janvier la CotonTchad a connu un retard qui a duré plus de trois semaines.

Plainte: La société seyal TCHAD fait de l'import-Export des matières premières. En ce jour de 15 janvier 2023 elle importe 40 tonnes de sucre en provenance du Brésil et durant tout le trajet à l’intérieur du Cameroun les deux véhicules ont subit plus de dix arrêts successifs pour des motifs illégales et souvent demandés les taxes qui n'existent pas officiellement. Ces multiples sollicitations ont fait perdre plus de deux jours à la société.

Plainte: la société IBA export a un contrat d'exportation avec une entreprise en Indonésie. A titre expérimentale elle est autorisée a exporter un conteneur de 19 tonnes à JAKARTA. Une fois au port Douala, les autorités portuaires camerounaises ont bloqué l'exportation car selon eux le certificat 'd’origine du Tchad est établi en français et ne semble pas contenir toutes les informations nécessaires.

Plainte: 04 conteneurs de la gomme arabique de la variété kitir ont été stoppés à la frontière entre le Cameroun et le Tchad car les douaniers camerounais ont demandés les documents attestant de la fumigation de la gomme. C'est à quoi la société a répondu que cela ne fait pas partie des exigences du client. Les 04 conteneurs ont mis environ une semaine avant d’être autorisés a pénétré en territoire camerounaise.

Plainte: La société AMAL GLOBAL transporte dix conteneurs de 19 tonnes de sésames blancs vers le Cameroun. Le convoi fut arrêté à la frontière dans la ville de TOUBORO. Ayant présenté tous les papiers exigés par les douaniers, ces derniers ont finalement demandé des analyses biologiques du produit. Ce document ne figure pas dans les documents de la procédure d'exportation s'en suivit une longue discussion qui a immobilisé les conteneurs à la frontière pendant une journée.

Plainte: Quatre conteneurs de gomme arabique en provenance du Tchad furent stoppés à la frontière avec le Cameroun à l'entrée de la ville de TOUBORO. Les véhicules transportant les produits de la société NOSOCOGEN ont été stoppés sous le pretexte que la gomme n'a pas été connu un traitement aux normes internationales. Le chauffeur a présenté la facture d'origine et expliqué que cette exigence devrait provenir du client en Turquie et non les autorités camerounaises. La société a perdu plus d'une semaine avant de convoyer les produits au port de Douala

Plainte: la Société GAMAR FOOD exporte la viande depuis le Tchad vers le Gabon. le 19 janvier 2023 son véhicule contenant un conteneur frigorifique a été arrêté pour des raisons de normes sanitaires à la frontière. Cet arrêt est illégal au vu des accords de coopération entre les deux pays et de la certification qualité que détient la société. Le convoi a attendu plus de 04 heures avant une autorisation de circuler.

Plainte: La société AMAL GLOBAL convois en cette journée du 25 mars 2023 deux conteneurs de vingt tonnes de sésames vers le Cameroun. Le véhicule a été arrêté par des hommes portant des uniformes de plusieurs corps de métiers ( police, gendarmerie, douanes) pour des raisons de contrôles d'armes. Une longue file de camion a été arrête a cette frontière et le conteneur est finalement parti de la avec deux jours de retard supplémentaire.

Plainte: Le ministère en charge du commerce a pris l’arrêté pour conditionner l'exportation de la gomme arabique et le sésame par une autorisation spéciale. Pour avoir cette autorisation le ministère exige au moins une dizaine de pièces administratives. Cette autorisation est ainsi difficile a obtenir et constitue une barrière non tarifaire.

Plainte: A Gambian bus with cross border traders and other passengers going to Dakar was stopped and refused entry after being issued an interstate transport licences by the ministry of transport of The Gambia. The Karang drivers mobilized against the bus with the help of the Senegalese Gendarmes to turn the bus back to The Gambia. Transport unionists in Senegal on Monday stoned a Gambia Transport Service Corporation bus, injuring a passenger and leaving many others in distraught as the vehicle retreated to Gambian territory late night. Another Similar incident is a bus was denied entry by the unionists who blocked its way even after the intervention of police, customs and other Senegalese security officials. The unionists complained that the service from the Gambia is taking their market.
A different bus was also blocked from entering Senegal a few days earlier and was only allowed to proceed after the intervention of the Senegalese High Commissioner in The Gambia among other officials.

The Standard contacted the managing director of the GTSC for comments on the matter. He advised that refusal of entry is a violation of both the ECOWAS and bilateral protocols agreed between The Gambia and Senegal. “The first place to start is to highlight that there is an agreement between Senegal and The Gambia for our public bus services to run two services from both directions a day, meaning two Gambian buses leaving Banjul to Dakar and vice verse. The same agreement provides for Senegalese public bus service to operate the same number daily. Also sometime in 2018, the Gambian and Senegalese transport ministers signed a protocol which allows both countries to operate 150 cross-border trips for Senegalese operators and 100 for Gambian operators. And these do not include public transport bus service. All these are in addition to the ECOWAS protocols which allow free movement of goods and people in the region. The latest incident came after the GTSC responded to a Gambia government announcement that Gambia public transport and that of Senegal can operate unlimited cross-border service to the two countries. So we put an additional service last week which was blocked and later allowed but on Monday, they blocked our bus and on its way back, some people stoned it and put the passengers in grave danger with one of them sustaining injuries,” the managing director of the GTSC said.

This NTB was reported on 17 January 2020 by the Gambia Chamber of Commerce and Industry. The incident concerned Gambia Transport Service Company (GTSU) buses that are often used to transport cross-border traders on a daily basis to and from Dakar. Following the report of the NTB on the online platform, the National Focal Points engaged in a series of consultations and negotiations among stakeholders at national level and bilaterally. On 12 March 2020, at the bi-annual Presidential Council meeting, the Presidents of the Gambia and Senegal made a joint declaration to immediately resolve the reported NTB. The Presidential Council meeting was preceded by the Ministerial Committee meeting and Expert Committee meeting on the 11 and 12 of March 2020, where a detailed transport Accord was agreed and signed. However, before the implementation of the Accord, the Covid-19 pandemic forced both countries to close all borders. With the opening of borders on 1 April 2021, GTSU buses resumed their regular two daily bus services from Banjul to Dakar without any incidence reported. After further consultations with the concerned stakeholders, the NTB can now be declared resolved.

Cette barrière non tarifaire (BNT) a été signalé le 17 janvier 2020 par la Chambre de commerce et d'industrie de la Gambie. L'incident concernait des bus de la compagnie Gambia Transport Service Company (GTSU) qui sont souvent utilisés pour transporter quotidiennement les commerçants transfrontaliers à destination et en provenance de Dakar. À la suite du signalement de la BNT sur la plate-forme en ligne, les points focaux nationaux ont engagé une série de consultations et de négociations entre les parties prenantes au niveau national et bilatéral. Le 12 mars 2020, lors de la réunion semestrielle du Conseil présidentiel, les Présidents de la Gambie et du Sénégal ont fait une déclaration commune pour résoudre immédiatement la BNT signalée. La réunion du Conseil présidentiel a été précédée d’une réunion du Comité ministériel et de celle du Comité d'experts le 11 et 12 mars 2020, au cours desquelles un accord détaillé sur le transport a été convenu et signé. Toutefois, avant la mise en œuvre de l'accord, la pandémie de Covid-19 a contraint les deux pays à fermer toutes les frontières. Avec l'ouverture des frontières le 1er avril 2021, les bus de la compagnie GTSU ont repris leurs services réguliers de bus deux fois par jour de Banjul à Dakar sans qu'aucun incident ne soit signalé. Après de nouvelles consultations avec les parties prenantes concernées, la BNT peut maintenant être déclaré résolue.

Plainte: Passenger buses traveling from Banjul to Dakar , are denied entry into Senegal by the Senegalese Transport Union. Both the 11 and 12th of January , buses are denied entry into Senegal by drivers Union at Karang in Senegal.
